Now, Judge Beth Bloom of the United States District Court for the Southern District of Florida has ruled in favor of the plaintiffs. Despite the hackers’ identities being unknown, the judge declared that they were responsible for the theft and had to repay a substantial amount and interest accrued over time.

First incident using NFTs to deliver notifications in the US

According to recent court filings, Bandyopadhyay has issued a formal notice of legal action using non-fungible tokens. This was after Judge Bloom ruled that it was correct to use his NFTs to serve these anonymous individuals whose identities and residences remain unknown. Therefore, court documents were served using the same on-chain address used to withdraw funds from plaintiffs’ wallets.

Court filings show that the funds were transferred after being withdrawn from Bandyopadhyay’s Coinbase wallet, before finally being transferred to the exchange pool on Binance. Now that the judgment has been handed down, it remains unclear how the funds will be recovered.

But according to Bandyopadhyay’s lawyer, Fernando Bobadilla, they are confident they will be able to recover at least some of the money. The key lies in the transparency and traceability provided by blockchain. So you can see how the funds move and where they end up, despite being anonymous.

Speaking to the press, Bobadilla said: “These scammers are usually dressed in non-U.S. costumes, and everything they tell their victims is a lie about their identity. Move. The ledger is there and they can’t hide it.”

At present, it remains to be seen whether the plaintiff will succeed in recovering the stolen USDT.
